1. Introduction

Welcome to Fine Wine Library B.V. ("we," "us," "our"). By accessing our website and purchasing our products or services, you agree to comply with and be bound by the following terms and conditions ("Terms"). Please read these Terms carefully before placing an order and retain a copy for future reference.

 

2. Company Information

3. Registration

To register on our website or place an order, you must be 18 years of age or older. You are responsible for ensuring that all information provided during registration is accurate and complete.

If any of your details change, you must update your account information promptly to ensure that we can communicate with you effectively.

 

4. Password and Security

If you register on our site, you may be issued a password. You must keep this password confidential and not share it with anyone.

If you suspect that someone else has access to your password, you must notify us immediately at [email protected]. We reserve the right to require you to change your password or suspend your account if we believe there is a security breach or misuse of our website.

 

5. Intellectual Property

All content on our website is protected by copyright, trademarks, database rights, and other intellectual property laws.

You may display the content on your screen, store it for personal use, or print one copy for reference, provided that all copyright and proprietary notices remain intact.

You may not reproduce, modify, copy, distribute, or use our website content for commercial purposes without our prior written permission.

 

6. Orders, Payment, and Cancellations

• Availability: All products are offered subject to availability. If a product becomes unavailable after an order is placed, we will notify you promptly.

• Pricing: Prices are quoted in euros (€) per bottle or case, both In Bond and duty-paid in the Netherlands. Orders for home delivery within the Netherlands are subject to applicable duty and VAT rates. Prices are subject to change without notice; however, once an order is placed and payment is received, the price is fixed for one month from the order date.

• Payment Methods: We accept Visa, Mastercard, American Express (Amex) and iDeal. 

• Order Cancellation by Us:
  We reserve the right to cancel or credit any order due to errors on our e-commerce platform, including but not limited to:

  • Incorrect pricing
  • Product availability issues
  • Typographical errors in product descriptions
  • Technical errors affecting the checkout process
  • Pack size errors

If an order is cancelled, we will notify you as soon as possible and either provide a refund or offer an alternative product.

 

7. Title and Risk

The title to all products remains with Fine Wine Library B.V. until full payment is received. The risk of loss or damage passes to you upon delivery.

 

8. Delivery

• Domestic Delivery: Free for orders €250 or more. Orders below this amount will incur a delivery fee.
• International Delivery: Import duties, tariffs, and taxes may be incurred and are your responsibility. As the importer of record, you must ensure compliance with local laws.

 

9. En Primeur

What is En Primeur?

En Primeur, or Wine Futures, is the process of purchasing wines before they are bottled and released onto the market. Wines are usually delivered 2-3 years after the vintage and can only be bought by the unmixed case (12 bottles, 24 half bottles, 6 magnums, etc.).

 

In Bond

En Primeur wines are initially stored In Bond (meaning no duty or VAT has been paid). If you request delivery within the EU, you will be responsible for paying the applicable duty and VAT. You may also choose to keep the wine In Bond; contact us for storage options.

 

Prices

En Primeur prices are quoted In Bond and include freight and delivery to our bonded warehouse. Prices may fluctuate due to currency changes and market demand.

 

Delivery & Storage

Wines purchased En Primeur will be delivered according to our normal delivery terms. Alternatively, customers may request storage under Private Reserve. Storage fees will apply after the first 30 days.

 

Vintage Closing Dates & Shipping

Each En Primeur vintage will have a closing date for orders. Anticipated shipping dates will be provided but are not guaranteed.

 

Order Allocation

Due to high demand, wines may be subject to allocation. We will distribute stock fairly among customers but cannot guarantee fulfilment of all requests.

 

10. Quality Control and Acceptance

All wines are sourced from reputable suppliers. However, we do not guarantee taste or drinkability, especially for older wines.

Upon delivery, you must inspect your order and report any issues within five working days. After this period, the order is deemed accepted, and no claims will be processed.

 

11. Fault & Corked Wine

We do not accept responsibility for wine faults, including cork taint, oxidation, or spoilage. Older wines may develop inconsistencies, and we do not provide refunds for these issues.

Any compensation is entirely at our discretion.

 

12. Storage Services

• Free Storage: 30 days of free storage after purchase. This is calculated from purchase if wine is in stock and from the date of arrival if the wine bought is pre-arrival.
• Extended Storage: €1.00 per 6x75cl case, €2.00 per 12x75cl case per month, including VAT.
• Non-Payment: We reserve the right to liquidate stored wines if fees remain unpaid.

 

13. Force Majeure

We are not liable for failure to fulfil obligations due to circumstances beyond our control, such as:

• Natural disasters
• Pandemics
• War or civil unrest
• Governmental restrictions

By placing an order, you agree to be added to our mailing list. You may unsubscribe at any time by contacting us at hello@finewinelibrary.nl.

 

15. Security and Privacy

We prioritize your security and use advanced encryption systems. Payments are processed through trusted services for maximum security.

 

16. Liability and Indemnity

We are not liable for indirect or consequential loss. You agree to indemnify us against any claims arising from misuse of our website or products.

 

17. Disputes and Governing Law

These Terms are governed by Dutch law. Disputes will be subject to the exclusive jurisdiction of the courts of the Netherlands.

 

18. Changes to These Terms

We may update or modify these Terms at any time without prior notice.
